Parti Keadilan Rakyat (PKR) vice-president Chua Tian Chang (pix), also known as Tian Chua, will defend his Batu parliamentary seat.
PKR president Datuk Seri Dr Wan Azizah Wan Ismail said in a statement today that Tian Chua was nominated despite being fined RM2,000 by the High Court for biting a policeman during a demonstration in 2009.
"PKR takes the view that Tian Chua is qualified to stand as a candidate notwithstanding a RM2,000 fine meted out to him in a criminal prosecution," she said.
On June 17, 2010, High Court judge Ghazali Cha reduced a magistrate's court ruling on the case to a RM2,000 fine or two months' jail from the initial RM3,000 fine and six-month jail term.
The judge also ruled that the fine did not disqualify him from being an MP.
"PKR expects that the Election Commission will instruct the returning officer in Batu accordingly," Wan Azizah said.
Meanwhile, PKR secretary-general Saifuddin Nasution Ismail said the allocation of seats within Pakatan Rakyat (PR) was determined by three principles aimed at ensuring that PR defeats Barisan Nasional (BN).
Seats won by a PR component party in 2008 would continue to be maintained by it.
A member of a party who is acknowledged as a 'winnable' candidate should be given priority to defend the proposed seat.
Lastly, seats that were lost in 2008 and are still maintained by PR can be negotiated among component parties with the aim of overthrowing BN.
